IMHO you should use plenum whether it's code or not. Maybe it seems like a waste of money but I'd rather spend the extra $200 per spool to know that if a fire ever happens, death by burning PVC fumes is not on the list of threats... Just that much more of a fighting chance for the people trying to get out. One father of 5's $0.02. :) I know several people who have put the wiring in the walls (i.e. running through holes in the 2x4's before putting up the drywall). The last one who did it, did so with the permission of the builder, so hey, I'm no architect but I'd say go for it.
